The Copyright Alliance’s Small Claims Opt-Out Protection (SCOOP) Program will run from August 1, 2022 to December 31, 2023. The Copyright Alliance may extend or reduce the duration of the program as it deems necessary due to factors such as program participation or funding limitations. The following are the terms and conditions for participation in the program.
- SCOOP PROGRAM REQUIREMENTS
- All of the following requirements must be satisfied in order to participate in the SCOOP Program:
- before filing a claim with the CCB, the applicant must have watched the Copyright Alliance’s Learn About the Copyright Claims Board video and/or must have become a Copyright Alliance member;
- the applicant must be a member of the Copyright Alliance by the time they apply to participate;
- the applicant must have had their CCB case dismissed by the CCB due to a respondent opting out;
- the applicant completed and submitted the SCOOP Program application; and
- the applicant must provide truthful, correct, and complete information in the SCOOP Program application.
- The following factors may result in a denial of an application:
- the applicant filed the CCB case with a co-claimant(s);
- the applicant does not reside in the United States;
- the information provided in the application creates an actual or potential conflict of interest for the Copyright Alliance;
- the applicant was reimbursed three times through the SCOOP Program;
- the applicant did not comply with SCOOP Program requirements; or
- other factors as determined by the Copyright Alliance.
- All of the following requirements must be satisfied in order to participate in the SCOOP Program:
- DISCLAIMERS ABOUT THE SCOOP PROGRAM
- The Copyright Alliance has the sole right at any time to control, determine, or change criteria for accepting or denying a SCOOP Program application, or for issuing a reimbursement check for any reason.
- The Copyright Alliance does not guarantee that a review of a SCOOP Program application, a decision to approve or deny a SCOOP Program application, or the issuance of a reimbursement check will be conducted or completed within a certain timeframe or by a certain date, and shall not be liable or responsible for any injuries which may result.
- The Copyright Alliance is not liable or responsible for any damages, claims, or injury related to the Copyright Alliance’s decision to deny an application or to not issue a reimbursement check, or for the applicant’s actions or inactions.
- MISCELLANEOUS
- The Copyright Alliance may use information applicants disclosed to it for the SCOOP Program, to collect and report aggregated and anonymized data, such as how many applicants applied to the SCOOP Program and other SCOOP Program metrics.
- These terms and conditions represent the entire understanding between the parties and supersedes all prior communications, contracts, or agreements whether oral or written between the parties related to the application. These terms and conditions cannot be amended or modified in any way by the applicant.
