How to Register AI-Generated Works with the Copyright Office?

Currently, it is not possible to register an AI-generated work with the U.S. Copyright Office if the work was solely generated by AI. However, it may be possible to register a work that contains a mixture of human-authored and AI-generated elements. In 2023, the U.S. Copyright Office issued a guidance to its registration practices stating that the Office will:

  • refuse to register AI-generated output because such output is not authored by humans and are not protected by copyright law; and
  • register human-created copyrighted works that contain AI-generated elements, provided that the applicant disclaims any AI-generated elements that represent more than de minimis amountand claims only the human-authored elements.
