On September 26, the U.S. Copyright Office published a supplemental notice of proposed rulemaking (SNPRM) to further clarify policies and procedures surrounding royalty distribution and dispute resolution practices for royalties administered by the Mechanical Licensing Collective (MLC). The SNPRM includes additional analysis on the application of the derivative works exception to the statutory termination right (“Exception”) in the context of various royalties administered by the MLC. Comments were originally due October 26 and reply comments are due November 13, but those deadlines were extended to November 8 and November 28, respectively.
