The Scope of Fair Use

The Copyright Alliance supports fair use and is dedicated to ensuring that the balance the Constitution and Congress struck to provide robust copyright protections to authors and meaningful exceptions for fair use is maintained. When appropriately scoped, fair use complements and serves the long-standing goals of copyright to promote the creation and dissemination of new works; however, some courts have misapplied fair use in recent years, diverging from traditional fair use principles and undermining the ultimate purpose of copyright law. The best solution at this point would be for the U.S. Copyright Office to facilitate discussions on guidelines for best fair use practices.
