Deadline for Submitting Initial Comments to USCO on Its NPRM on Law Student and Business Entity Representation Before the CCB

On December 30, the U.S. Copyright Office published a proposed rule regarding “procedures governing representation of parties by law students and representation of business entities by authorized individuals in proceedings before the Copyright Claims Board (CCB), [as] established by the Copyright Alternative in Small-Claims Enforcement (CASE) Act of 2020.” The proposed rule outlines the “threshold eligibility requirements” for law students to appear before the CCB, as well as “expectations for practice by law students and their supervising attorneys while participating in CCB proceedings.” It also references the creation of a public directory of clinics, which will be available to accept clients appearing before the CCB. Lastly, the proposed rule notes the “requirements that must be followed by individuals who will be authorized to represent business entities, which include corporations, limited liability companies, partnerships, and sole proprietorships.” Initial comments on the proposed rule are due on February 3, 2022, and reply comments are due on February 18, 2022.
